Terms & Conditions
The Customer is requested to accept these Conditions during the purchase process and at
the latest when entering into an Agreement with Sunset Paradise Events.
Liability of the organiser
The Organiser shall only be liable for damages directly and exclusively resulting from an
error by the Organiser. Excluded from compensation are damages and losses caused by Force Majeure, consequential damages and damages caused by misconduct, recklessness or serious fault by the damaged party.
The Festival Organiser is not liable for damages, theft or any accidents to vehicles or persons inside or outside the terrain of the pop up camping Tomorow's Paradise. The use of the parking lots is always at own risk.
Privacy
Sunset Paradise Events collects your personal data when you purchase any of the products and services we provide or when contacting us while seeking information about our products
or services.
Processing of your personal data is necessary for the performance of a contract or on the basis that the processing is necessary for the purposes of the legitimate interests of our Events. These legitimate interests are that the processing of the personal data is necessary for us to be able to identify you as a user on our Websites.
The personal data Sunset Paradise Events collects are:
Nominative Information: Title, first name(s), surname(s): Your nominative details are needed to properly identify you, to communicate with you, to provide you with the products and services you have requested.
Full postal work and/or private address: The postal address is needed because it helps to correctly verify your identity (where other persons have the same or a similar name).
E-mail address: We only keep your e-mail address if you have provided via our Websites
when you register for for a newsletter, for example. Only then will we use it to inform you about our best deals. If you no longer wish to receive e-mails from us, simply give us a message to unsubscribe.
Image rights
By entering the pop up camping Tomorrow's Paradise areas each person gives his or her express consent to the fact that he or she may be photographed and filmed (“Recording”) and that these Recordings may be stored and distributed. This includes any film, photography, audio and/or audiovisual transmission or recording.
Therefore, when purchasing Festival Products and/or Services and/or attending the Pop up Camping Tomorrow's Paradise, you agree to, authorize and grant the right to use of your image, name and voice as part of the Recordings, free of charge and without limitation, and without characterizing misuse of image or any other violation of rights, considering the fact that the visitors of the Pop up Camping Tomorrow's Paradise may be filmed, recorded or photographed, at the Organiser’s discretion, for subsequent
publication, transmission, retransmission, reproduction or distribution on TV, VOD, cinema, radio, internet, streaming, advertising or any other means of communication, DVD and home-video production by the Festival Organiser or by third parties, at
the Organiser’s discretion.
The Organiser may also use these Recordings to promote and report about Tomorrowland
Belgium, with the aim of ensuring the security of the Festival and/or provide them to the authorities for the purpose of investigating illegal activities and as a means of identifying, tracking and facilitating sanctioning those responsible.
No right of withdrawal
The right of withdrawal is expressly excluded based on Article VI.53, 12° of the Belgian Code of Economic Law. This means that you do not have a cooling-off period of fourteen (14) days to revoke, cancel or return the purchase of Festival Products and/or Services.
Cancellation and Refunds
Travel Packages are refundable in accordance with the following cancellation conditions:
• Cancellation before February 19, 2024: 80% of the total package price will be
refunded;
• Cancellation before March 18, 2024: 50% of the total package price will be
refunded;
• Cancellation before May 31, 2024: 30% of the total package price will be refunded;
• Cancellation after May 31, 2024: no refund will be provided.
You acknowledge that the non-refundable part of the package price shall constitute a reasonable cancellation fee.
The cancellation request can be submitted in writing to events@sunsetparadise.es and must include full name and e-mail address of the Main Buyer, date of purchase and ordernumber. Requests will be reviewed, processed, and responded to within 40 days. Cancellation requests which do not include the aforementioned information in full will be considered null due to lack of data allowing for identification of the order.
Please make sure to check your packages very carefully. Changes of certain elements of your package such as transportation, accommodation and/or type of entrance ticket will not be possible after reservation and booking.
Sunset Paradise Events holds the right for cancellation at any time if there are acceptable reasons to do so. In that case you will get a full refund of the purchase price you have paid including delivery costs.
If the event is cancelled or is postponed, Sunset Paradise Events will give the buyer a notice. If news tickets are issued for a postponed event, no addition fees will be charged. Sunset Paradise is not responsible for any cancellations made by the organiser of the event.
If events are cancelled or postponed because of Force Majeure ( as further explained under this article), the buyer may terminate the Agreement and will be entitled to a refund of the total amount they have paid including delivery costs. In that case, Sunset Paradise Events is allowed to offer the Buyer a voucher or coupon of the same value instead of a refund of the purchase price (including delivery costs) or a combination of avoucher or coupon and a partial refund of the purchase price. This depending on the official communication and proposal from Tomorrowland Official.
Force of Majeure
means the occurrence of events or matters which make performance of obligations (excluding payment obligations) and/or the Event impossible, impracticable or unsafe, including without limitation an act of God (including without limitation earthquake and avalanche), inevitable accident, fire, strike or other labor dispute, war or threat of war, act of public enemy, act of terrorism or threats thereof, riot or civil commotion, national state of emergency, enactment, rule, order or act of any government or governmental instrumentality, political instability, failure of technical facilities, epidemic (including a health epidemic), pandemic (including a health pandemic), interruption in, or substantial delay or failure of, technical facilities, or failure or substantial delay of necessary transportation services, travel restrictions and travel bans, bad weather conditions that are sufficiently severe or imminent, or any other exceptional and/or unpredictable event or exceptional and/or unpredictable condition beyond Parties’ control, as applicable. A Force Majeure Event in respect of either Party’s suppliers, manufacturers or Affiliates that makes performance of obligations (excluding payment obligations) under this Agreement and/or the Event impossible, impracticable, or unsafe shall be considered a Force Majeure Event in respect of the relevant Party. Furthermore, a Force Majeure Event may also constitute the circumstance under which the Event’s site is declared unusable, inefficient, unserviceable, and dangerous or in any other way declared inaccessible by the authorities.
Tickets and Bracelets
• Tickets for the Festival and/or Tomorrowland Bracelets are in principle non- refundable or -exchangeable.
• In case of loss or theft of Festival tickets and/or Tomorrowland Bracelets, these will not be replaced or refunded.
• Persons under 18 will not be admitted, even if accompanied by a parent, guardian and/or other adolescents. Festival Visitors born in 2006 will be admitted to the Festival, even if the age of 18 is not reached until after the Festival.
• The Organiser and/or the official ticket vendor reserve the right to check the identity of the Festival Visitor when checking the ticket and/or scanning the Tomorrowland Bracelet. If you are unable to present a valid identification document, security is authorised to refuse you access to the Festival and/or DreamVille. The following are considered valid identification documents: identity card, passport or driving licence. Copies will not be accepted. If you are caught with a false identity document, this will be considered identity fraud and
you will be refused entry to the Festival. You will also face criminal charges.
• Tickets for the Festival, for DreamVille and/or Tomorrowland Bracelets may not
be used for commercial or promotional purposes without prior permission from
the Festival Organiser.
• Tickets for the Festival, for DreamVille and/or Tomorrowland Bracelets may not
be resold without the express and written consent of the Festival Organiser or official ticket seller. Tickets for the Festival and/or DreamVille that are resold without this express and written consent of the Festival Organiser and/or
official ticket vendor shall not entitle you to access the Festival and/or DreamVille. The Festival Organiser and/or official ticket vendor also reserve the right to cancel tickets for the Festival as soon as it is established that those tickets for the Festival have been offered for sale despite this prohibition. The costs resulting from such cancellation shall be recovered from the buyer.
• Changes in the line-up will not result in a full or even partial refund of the ticket for the Festival and/or DreamVille.
• Forgery of tickets, Vouchers and/or Tomorrowland Bracelets will be prosecuted.
• Visitors may not enter areas to which their Tomorrowland Bracelet does not grant access (e.g. DreamVille, the comfort zone, press zones, backstage, the 'front of house'/direction zone, stages, etc.).
Applicable law, competent court and OD
These Conditions are governed exclusively by Belgian law, to the exclusion of the rules of international private law.All disputes shall be settled by the competent court in Antwerp, to the exclusion of all other courts. However, the Festival Organiser reserves the right to
file a claim with the court that would be competent under the legal jurisdiction rules.
The Organiser hereby informs You of the existence of the European Union's 'Online Dispute Resolution' platform. In the event of a dispute, the Festival visitor may request an out-of-court dispute resolution request at http://ec/europa.eu/odr.
Other provisions
If any provision of these Conditions, or any part thereof, is or is declared invalid or unenforceable, the remaining provisions of these Conditions or the remainder of that provision shall remain in full force and effect and such provision shall be automatically replaced (by operation of law) by a valid provision that is as close as possible to the invalid provision.
